2. Question: How can the National Marine Fisheries Service of the US Government tell us what to do on the Rogue River?

Answer: The National Marine Fisheries Service (NMFS) listed the Coho Salmon as a threatened species on the Rogue River several years ago. Under the Endangered Species Act (ESA), NMFS has the authority to set the standards for the fish screening and fish-taking rules. This is federal law. Without compliance to NMFS standards, we can not operate the turbines that deliver water to the Tokay and Highline Canals. Virtually 2/3 of the district can not irrigate.
